1. Agreement to Terms

By accessing or using Poland API ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Poland API provides programmatic access to comprehensive data about Polish territorial units, including municipalities (gminy), counties (powiaty), and provinces (województwa). The Service is provided through a RESTful API accessible via RapidAPI marketplace.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. API Access and Registration

3.1 Account Creation

To access the API, you must register through RapidAPI and obtain an API key. You are responsible for:

  • Maintaining the confidentiality of your API key
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

3.2 Account Requirements

You must:

  • Be at least 13 years of age
  • Provide accurate and complete registration information
  • Keep your account information up to date
  • Not share your API key with third parties

4. Acceptable Use

4.1 Permitted Uses

You may use the API to:

  • Access and retrieve data about Polish territorial units
  • Integrate the data into your applications or services
  • Display and present the data to end users
  • Cache data for reasonable periods to improve performance

4.2 Prohibited Uses

You may NOT:

  • Exceed your subscription tier's rate limits
  • Resell or redistribute the API or its data
  • Use the API to create a competing service
  • Attempt to circumvent security measures or authentication
  • Use the API for illegal purposes or to violate any laws
  • Scrape, harvest, or systematically download the entire dataset
  • Reverse engineer, decompile, or disassemble the Service
  • Use the API to send spam or malicious content
  • Overload or attempt to disrupt the Service (DDoS attacks)
  • Access the API through automated means (bots) without permission

5. Rate Limits and Usage Quotas

API usage is subject to rate limits based on your subscription tier. Rate limits include:

  • Requests per second/minute/day limits
  • Monthly quota restrictions
  • Concurrent connection limits

Exceeding these limits may result in temporary or permanent suspension of your API access. We reserve the right to modify rate limits with reasonable notice.

6. Payment and Subscription

6.1 Fees

Access to the API is provided on a subscription basis through RapidAPI. Fees are determined by your chosen subscription tier and are subject to change with 30 days' notice.

6.2 Billing

All billing and payment processing is handled by RapidAPI. You agree to pay all fees associated with your subscription. Failure to pay may result in suspension or termination of service.

6.3 Refunds

Subscription fees are non-refundable except as required by law or as explicitly stated in your subscription agreement.

7. Intellectual Property Rights

7.1 Our Rights

The Service, including its original content, features, and functionality, is owned by Poland API and is protected by international copyright, trademark, and other intellectual property laws.

7.2 Data Source

The underlying territorial data is sourced from official Polish government databases and is considered public domain information. However, our API structure, documentation, and presentation are proprietary.

7.3 Attribution

When using data from our API in public-facing applications, we request (but do not require) that you provide attribution to Poland API.

8. Data Accuracy and Updates

We strive to maintain accurate and up-to-date information. However:

  • We do not guarantee the completeness or accuracy of the data
  • Data is updated periodically based on official sources
  • We are not liable for decisions made based on this data
  • You should verify critical information with official sources

9. Service Availability

We aim to provide 99.9% uptime, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (with advance notice when possible)
  • Emergency maintenance or repairs
  • Events beyond our control (force majeure)
  • Security incidents or attacks

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or availability

We do not warrant that the Service will be error-free, secure, or meet your requirements.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLAND API SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Damages arising from your use or inability to use the Service
  • Any damages exceeding the amount paid by you in the past 12 months

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Poland API, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit or transmit through the Service

13. Termination

13.1 Termination by You

You may terminate your account at any time by canceling your subscription through RapidAPI.

13.2 Termination by Us

We may terminate or suspend your access immediately, without prior notice, for any reason, including:

  • Breach of these Terms
  • Non-payment of fees
  • Fraudulent or illegal activity
  • Excessive or abusive use

13.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. You remain liable for all fees incurred prior to termination.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the new Terms on this page
  • Updating the "Last updated" date
  • Sending an email notification (for significant changes)

Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Poland.

16. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms:

  1. Parties agree to first attempt resolution through good-faith negotiation
  2. If negotiation fails, parties may pursue mediation
  3. Only after these steps may parties pursue legal action

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible, and the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and Poland API regarding the Service and supersede all prior agreements and understandings, whether written or oral.
